Baby Powder Lawsuit & Settlement History

Deane Berg filed the first lawsuit against Johnson & Johnson after her doctor diagnosed her with ovarian cancer in 2006. Berg allegedly developed cancer only after using Johnson & Johnson’s talc-based products regularly for decades. Berg won her baby powder lawsuit after going to trial in 2013, but the jury did not award her any damages. However, that ruling paved the way for more than 16,800 baby powder lawsuit claims now pending against Johnson & Johnson.

Recent Baby Powder Lawsuit Verdicts & Settlement Amounts

Many people received baby powder lawsuit settlements since Berg successfully sued Johnson & Johnson. Below are a list of the verdict dates and settlement amounts:

  • $4.69 billion in damages awarded to 22 anonymous baby powder lawsuit plaintiffs with ovarian cancer in December 2018
  • $325 million to Donna Olson for her mesothelioma baby powder lawsuit in May 2019
  • $186.5 million in punitive damages to four anonymous New Jersey baby powder lawsuit plaintiffs, February 2020
  • $117 million to Stephen Lanzo in April 2018, who developed mesothelioma after using talcum powder for 30 years
  • $40.3 million to Nancy Cabibi in October 2019, who proved asbestos in J&J’s baby powder led to her terminal lung cancer
  • $37.3 million in compensatory damages to four anonymous New Jersey baby powder lawsuit plaintiffs, September 2019
  • $29.4 million to Teresa Leavitt in March 2019, who developed mesothelioma from inhaling talcum powder contaminated with asbestos
  • $25.75 million to Joanne and Gary Anderson in May 2018, who successfully sued Johnson & Johnson for negligence
  • $9 million to Blanca Mure-Cabrera in February 2020, who developed mesothelioma from inhaling asbestos-tainted talcum powder
  • Over $2 million to Linda O’Hagan in January 2020 after J&J agreed to settle halfway through her baby powder lawsuit trial

J&J also agreed to several confidential out-of-court settlements during this time period for undisclosed amounts. This includes Laura Shanahan’s New York case, which the company settled prior to her December 2018 trial. Oklahoma City plaintiff Sharon Pipes, 77, also received an out-of-court settlement in March 2019 for her terminal cancer case. With over 16,800 baby powder lawsuit claims still pending, these multimillion-dollar payouts are likely far from over.

Johnson & Johnson Halts All U.S. Talcum Powder Sales in May 2020

Many baby powder lawsuit claims list a mining company called Imerys SA as a co-defendant alongside Johnson & Johnson. That’s because Imerys is the sole talc supplier for Johnson & Johnson’s flagship line of baby powder products. Since 2014, both companies spent millions on baby powder litigation costs. In May 2018, Imerys agreed to pay $5.5 to settle 22 ovarian cancer claims before the trial got underway. Its Imerys Talc America, Imerys Talc Vermont and Imerys Talc Canada units all filed for Chapter 11 bankruptcy in 2019.

In May 2020, Imerys agreed to auction those three North American units to settle over 14,000 baby powder lawsuit claims. Imerys will place all proceeds into a trust to compensate victims in exchange for dropping their claims against the supplier. Within days, Johnson & Johnson announced it would halt all talc-based powder sales in the United States and Canada. The company blamed the decision on declining product sales in recent years rather than litigation costs or consumer safety concerns. However, Johnson & Johnson will still sell talc-based products in other countries around the globe where consumer demand remains strong. Going forward, Americans can still purchase the company’s powder products made with cornstarch instead of talc as the key ingredient.
